Rental Terms Yourhostaanzee

This rental agreement governs the relationship between the owner (landlord) and you (tenant). Yourhostaanzee acts as the representative of the owner and is not a party to the rental agreement.

Definitions

Owner (we / us): the person who owns the property, and any property manager renting the accommodation on behalf of the owner
Tenant (you): the person renting the accommodation
Yourhostaanzee: the representative of the owner acting on behalf of the owner
Accommodation: the rented property in any form or under any name, including all movable and immovable items present at the start of the rental period
Guests: the persons staying in the accommodation under the rental agreement

Rental Property

1.1 You rent the accommodation as described in the booking form. Details about the location are provided in the booking confirmation
1.2 The accommodation can only be rented for a period of less than three months and for recreational purposes unless explicitly stated otherwise
1.3 We ensure the accommodation is clean at the start of the rental period and accessible during check-in times

Price

2.1 The prices listed are based on the situation at the time of your booking
2.2 We reserve the right to change the price if taxes or fees from third parties not directly involved in the service change (e.g. tourist tax)

Payment

3.1 The total rental fee (100%) is due thirty (30) days before your arrival date. A deposit may be required
3.2 In case of late payment, interest and collection costs may be charged according to Dutch law. If payment is not received within 14 days of a payment reminder, we have the right to cancel the agreement and claim compensation. A payment reminder can be sent by email
3.3 If the full rental fee or deposit is not received before arrival, our service will be suspended and you have no right to access the accommodation

Cancellations

4.1 Please note that you do not have the right of withdrawal after booking the accommodation
4.2 The following cancellation conditions apply
Cancellations within 30 days before arrival: up to 100% of the rental fee is due
Cancellations more than 30 days before arrival: the guest will be refunded 100% of the rental fee by Yourhostaanzee

Identification

5.1 Upon arrival, you may be asked to present a valid ID to verify your identity. If no ID is provided or the information does not match the booking details, we may refuse access to the accommodation
5.2 If legally required, you must provide personal information of yourself or guests as requested. Failure to provide such mandatory information may result in denied access to the accommodation

Responsibilities of You and Your Guests

6.1 You and your guests must comply with these terms and the house rules. You and your guests will not cause any disturbances
6.2 If you or your guests violate these terms or house rules or cause disturbances, we have the right to terminate your stay and deny access. A warning is given only if reasonable under the circumstances
6.3 You will inform all guests of these terms and house rules. Guests are bound by these terms when using the accommodation

Check-in and Check-out

7.1 Check-in is between 16:00 and 22:00
7.2 Check-out is at 10:00

Deposit and Damage

8.1 A deposit may be required. Amount, due date, and rules are provided on the booking site
8.2 Upon arrival, you must inspect the accommodation and immediately report any damage to us or Yourhostaanzee. Damage not reported before 19:00 on the first day is presumed to have occurred during your stay
8.3 You are responsible for damage exceeding normal wear and tear
8.4 In case of disturbances, the deposit may be withheld
8.5 Swikly is the external party responsible for collecting and returning the deposit and independently deciding on any claims regarding the deposit. Both parties are bound by this decision

Liability and Force Majeure

9.1 We are not responsible for climatic phenomena or other types of force majeure. If we need to modify or cancel your stay due to force majeure, you are entitled to a proportional refund for the period in which no stay was provided. No additional compensation is due
9.2 If the reason you cannot stay is not our fault (e.g. guest illness, no-show), no refund is due
9.3 The accommodations are located in a natural environment near the dunes where field mice and other small animals may be present. Despite reasonable measures, their presence cannot be fully excluded. This is considered a natural risk and does not entitle you to compensation or refund

Complaints

10.1 If you have a complaint, you must notify us or Yourhostaanzee as soon as possible to resolve the issue
10.2 If the complaint is not properly resolved, it must be submitted in writing within one month after the stay. Late complaints will not be processed

Liability

11.1 Liability for damages other than personal injury is limited to the total rental fee
11.2 Liability for personal injury is limited to the coverage amount of our liability insurance
11.3 Limitations do not apply in cases of intentional acts, gross negligence, or where legally not allowed
11.4 All claims expire after one year

Other Provisions

12.1 Exceptions to these terms must be approved in writing by us
12.2 House rules and terms may be changed unilaterally by us. If core provisions are unreasonably affected, you may cancel within 14 days of notification
12.3 Bookings under false pretenses may be canceled by us. Prepayment and/or deposit remain due as compensation
12.4 This agreement is governed by Dutch law unless mandatory law states otherwise
